Terms & Conditions

Quotations - Published prices obtained from Growstrong are subject to change without notice and selling prices will be adjusted to reflect current Growstrong selling prices. Hand written quotations will be honored for 30 days after the date of the quotation.

Order Cancellation - No order may be canceled after acceptance, except upon terms that will compensate Growstrong for work completed at our regular hourly rates. There is a minimum $69 cancellation fee.

Returns for Credit - Because each order produced is a custom job no order may be returned for credit under any circumstances.

Warranty - Growstrong at its sole option will reprint any order that contains abnormal imperfections, fails to provide a reasonable representation to the approved color proof or where we have failed in your written instructions. Growstrong at its sole option may elect to provide a prorated credit in lieu of a reprint if the shortage, defective or damaged portion of an order does not exceed 20% of the ordered amount. Claims for defects, damages or shortages must be made by the customer in writing within (10) days after delivery. The customer must receive written authorization to return defective order or portion in advance of return. Defective orders must be returned within (30) days after delivery. Growstrong's sole liability shall be limited to the reprinting of any defective order or portion and in no case shall include special or consequential damages including customer expenses, profits or profit loss.

Production Schedules and Turnaround Times - Delivery schedules, turnaround times and other similar terms used by Growstrong merely reflect the average completion time of similar orders and will be affected by run lengths, special requirements, workloads, holidays or equipment breakdowns. It is not contractual unless agreed to in writing.

Ownership of Preparatory Materials - Artwork, type, film, digital files and plates produced by Growstrong in the ordinary course of production remain the exclusive property of Growstrong unless otherwise agreed to in writing.

Customer Disks, Film & Supplied Digital Information - All prices and quotations provided by Growstrong assume the customer provides properly prepared files & film. The customer accepts all responsibility for supplied files & film that fail to output properly, contains errors or provide an unacceptable result. Growstrong will make every effort to discover problems in the disk pre-flight stage but accepts no responsibility for errors not detected. Digital Images files & film supplied by the customer are the exclusive responsibility of the customer and Growstrong accepts no responsibility for the color accuracy or quality of these files & film.

Customer Changes - Customer changes represent work performed in addition to the original specifications. Such additional work shall be billed at our current rates. Customer changes will delay the completion and delivery of your order. The customer must approve the cost of these changes in writing prior to the beginning of work necessary to perform the changes.

Overruns and Underruns - Overruns and underruns not to exceed 10% of quantity ordered shall constitute an acceptable delivery.

Delivery - Unless otherwise stated, the price quoted is for a single shipment (one location) without storage, F.O.B Los Angeles County, CA. All shipping charges are in addition to the selling price of the job. Title for the finished work shall pass to the customer upon delivery.

Proofs - If you are submitting a digital file, you must submit a composite laser proof and a set of color separated laser proofs with your order. Growstrong will not produce or submit a proof for your approval or submit a proof for your approval. If you do not submit laser proofs as required, Growstrong will not be held responsible for errors or omissions and will not submit a fax proof for your approval. If composed film and proof are submitted, Growstrong will not produce or submit a proof for your approval. If Growstrong provides artwork or is instructed by the customer to modify a file we will fax a laser proof. Customer must sign off and fax proof back if ok to print. Low resolution RGB color images viewed via the internet as proofs deemed acceptable to print by customer in return fax shall be deemed acceptable although Growstrong is printing in CMYK color mode. Corrections to be made must be marked on the fax proof. The fax proof must be returned to Growstrong. Delay in returning the proof will delay in the completion of your job. Growstrong assumes no liability for errors contained in the job if proofs are waived or errors, typos, mis-spellings contained in the proof are not noted or if changes are communicated verbally.

Customer Furnished Materials - Camera ready copy, artwork, photos, film, color separations, digital files and other information or materials furnished by the customer shall be manufactured, packed and delivered to Growstrong specifications. Delays or additional expenses incurred, as a result of customer materials shall be responsibility of the customers. Growstrong will return all submitted transparencies, prints, logos or camera ready artwork with the printed job, at customers expense. We suggest you send high quality duplicates whenever possible, as Growstrong assumes no liabilities for lost or damaged materials.

Color Matching - Because of differences in equipment, monitors, paper and inks and other conditions between color proofing and production, pressroom operations, a reasonable variation in color between color proofs and the completed job is expected, unavoidable and shall constitute an acceptable delivery. Postcards and similar products are produced in a gang run format and limitations of this format may result in a larger color variance than normal. Growstrong will make every effort to produce a reasonable representation based on materials supplies by the customers, however, Growstrong does not guarantee color matching.

Payment Terms - Growstrong shall require cash payment in full at the time the order is placed. A $ 25.00 fee will be charged on all returned checks in addition to the original amount due.

Payment by Credit Card - Cardholders paying by credit card agree to be bound by all standards of Growstrong Terms & Conditions. You expressly agree to pay all costs incurred, even if your order is canceled before completion and understand that no order may be returned for credit. Credit card orders in excess of $100 will require the customer to furnish a copy of the front and back of the card including the signature for comparison to second ID. Order amount will be charged to credit card at order entry.

Indemnification - The customer affirms ownership or publication rights to all artwork, photos and other materials submitted for printing and agrees to indemnify and hold harmless Growstrong from any and all loss, cost, expenses and damages on account of any and all manner of claims, demands, actions and proceedings that may be instituted against Growstrong on grounds that said printing violates any copyright or any proprietary right of any person, or that it contains any matter that is libelous or scandalous, or invades any persons right to privacy or other personal right. The customer agrees to, at the customer's own expense, promptly defend and continue the defense of such claim, demands, actions or proceedings, that may be brought against Growstrong provided that Growstrong shall promptly notify the customer with respect thereto.
